Terms of Service

The rules of the road for using Social by InstantDM. Please read carefully — by using the service, you agree to all of these terms.

1. Acceptance of Terms

By accessing or using Social by InstantDM (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. The Service is operated by REPLBETTER APP TECHNOLOGIES PRIVATE LIMITED ("we", "our", or "us").

2. Description of Service

Social by InstantDM is a multi-platform social media scheduling and analytics platform that includes, without limitation:

  • Scheduling and publishing posts to Instagram, Facebook, X (Twitter), LinkedIn, TikTok, Pinterest, Threads and YouTube
  • Multi-account, team and approval workflows
  • AI-assisted caption, hashtag and asset suggestions
  • Analytics, reporting and content performance insights
  • Public API, webhooks and Model Context Protocol (MCP) endpoints for developers and AI agents
  • Integrations with third-party tools such as Make.com, Zapier, n8n, and similar automation platforms

3. User Accounts

3.1 Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Responsibilities

  • You must be at least 13 years old to use the Service.
  • You are responsible for all activities under your account.
  • You must comply with the Terms of Service, Community Guidelines and Developer Policies of every social network you connect (Instagram, Facebook, X, LinkedIn, TikTok, Pinterest, Threads, YouTube).
  • You must not use the Service for any illegal or unauthorized purpose.

4. Subscription and Payment

4.1 Pricing

We offer several subscription plans with different features, platform limits and pricing. Current pricing is available on our website and is denominated in U.S. Dollars or local currency where supported.

4.2 Payment Terms

  • Payments are processed through Stripe (international) and Razorpay (India).
  • Subscriptions are billed monthly or annually based on your selection.
  • All fees are non-refundable except as expressly set out in our Refund Policy.
  • We reserve the right to change pricing with at least 30 days' notice.

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months or unused portions of an annual plan.

5. Acceptable Use Policy

You agree not to:

  • Violate the Terms of Service or API policies of any connected social network.
  • Send spam, unsolicited messages or low-quality automated content at scale.
  • Engage in fraudulent, deceptive or misleading practices.
  • Harass, abuse or harm other users.
  • Attempt to circumvent our security measures, rate limits, or quota systems.
  • Use the Service to collect personal data without proper consent.
  • Resell, sublicense or redistribute the Service without our written authorization.

6. Third-Party Platform Compliance

The Service uses the official APIs of Instagram, Facebook, X, LinkedIn, TikTok, Pinterest, Threads and YouTube, and complies with each platform's developer policies. However, these platforms may change their policies, rate limits or available endpoints at any time, which may affect the functionality, availability or behaviour of certain features. We do not control and are not responsible for these third-party changes.

7. Service Availability

We strive to provide a reliable service but do not guarantee uninterrupted access. We may:

  • Perform scheduled or emergency maintenance and updates.
  • Modify, deprecate or discontinue specific features.
  • Suspend service for violations of these Terms.
  • Experience downtime due to technical issues or third-party platform outages.

8. Intellectual Property

All content, features and functionality of Social by InstantDM are owned by REPLBETTER APP TECHNOLOGIES PRIVATE LIMITED and protected by copyright, trademark and other intellectual property laws. You may not:

  • Copy, modify or distribute our software.
  • Reverse engineer or decompile our platform.
  • Remove copyright or proprietary notices.
  • Use our trademarks, logos or brand assets without written permission.

9. User Content

You retain ownership of the content you upload, schedule and publish through the Service. By using Social by InstantDM, you grant us a worldwide, royalty-free license to:

  • Store, process and transmit your content as required to operate the Service.
  • Display anonymized, aggregated usage data for analytics and product improvement.
  • Use feedback, suggestions and bug reports to improve the Service.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, consequential or punitive damages.
  • Our total liability is limited to the amount you paid in the twelve (12) months preceding the claim.
  • We are not responsible for social media account suspensions, content removals or bans imposed by any connected network.
  • We do not guarantee specific results, follower growth, engagement or business outcomes.

11. Indemnification

You agree to indemnify and hold harmless REPLBETTER APP TECHNOLOGIES PRIVATE LIMITED, its officers, employees and affiliates from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your account immediately if you:

  • Violate these Terms of Service.
  • Engage in fraudulent activity or chargebacks without prior support contact.
  • Fail to pay subscription fees.
  • Use the Service in a way that harms our platform, our infrastructure or other users.

13. Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with applicable laws. You waive the right to participate in class action lawsuits to the extent permitted by law.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by email or platform notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
